These Terms and Conditions (“Agreement”) govern all services and vehicle sales provided by Dakota Subaru Experts (“Company,” “we,” “our,” or “us”). By authorizing repairs, purchasing a vehicle, submitting a form, or using our services, you agree to the following terms.
1. Scope of Services
Dakota Subaru Experts specializes exclusively in Subaru vehicles and provides mechanical repair, diagnostic services, inspections, and vehicle sales.
All repairs are performed based on customer-authorized estimates. Additional repairs discovered during diagnostic or disassembly may require further authorization.
We reserve the right to decline service at our discretion.
2. Estimates & Diagnostics
Estimates are based on visible inspection and information provided at the time of evaluation. Mechanical issues may require disassembly or further diagnostic procedures to determine root cause.
Diagnostic fees apply to accurately identify vehicle concerns.
An estimate is not a guaranteed final price if additional issues are discovered during repair.
3. Authorization of Repairs
No repair work will begin without customer authorization.
Authorization may be provided through:
Signed written estimate
Digital approval (including platforms such as TechMetric)
Email confirmation
Text message confirmation
Customer approval constitutes agreement to the estimated cost and scope of work.
4. Payment Terms
Payment is due in full upon completion of repairs unless otherwise agreed in writing.
We reserve the right to retain possession of the vehicle until payment is received in accordance with applicable North Dakota lien laws.
Accepted forms of payment may include cash, credit/debit card, or approved electronic payment methods.
Returned payments may result in additional fees and collection actions.
5. Labor Warranty (12 Months / 12,000 Miles)
Dakota Subaru Experts provides a limited warranty on labor for 12 months or 12,000 miles (whichever occurs first) from the date of service, unless otherwise stated in writing.
This warranty applies only to defects in workmanship related to the specific repair performed by Dakota Subaru Experts.
This warranty does NOT cover:
Unrelated mechanical failures
Pre-existing conditions
Subsequent failures caused by other worn or failing components
Damage resulting from neglect, misuse, racing, overheating, accidents, or modifications
Failures due to lack of proper maintenance
Repairs altered or performed by another facility
Warranty claims must be inspected and approved by Dakota Subaru Experts prior to any repair performed elsewhere. Unauthorized third-party repairs void this warranty.
Remedy under this warranty is limited to re-performing the covered repair. No cash refunds will be issued.
6. Parts Warranty
Parts installed are subject to the manufacturer’s warranty, if applicable. Dakota Subaru Experts does not independently manufacture parts and is not liable beyond the applicable manufacturer warranty terms.
7. Used Vehicle Limited Warranty (1,000 Miles)
Unless otherwise stated in writing, vehicles sold by Dakota Subaru Experts include a limited 1,000-mile warranty from the date of sale covering:
Major internal engine failure
Major internal transmission failure
Repairs completed by Dakota Subaru Experts prior to sale
This limited warranty applies only to mechanical failures resulting from normal use.
This warranty does NOT cover:
Damage caused by accidents or collisions
Negligence, abuse, racing, or misuse
Continued operation after warning indicators
Lack of maintenance
Modifications made after purchase
Wear items including but not limited to brakes, tires, suspension components, belts, hoses, batteries, sensors, or electronics
Any warranty claim must be evaluated and repaired by Dakota Subaru Experts.
Repairs performed elsewhere without written authorization void this limited warranty.
This limited warranty is not a comprehensive vehicle warranty and applies only to the specific components listed above.
8. As-Is Vehicle Sales
Vehicles designated in writing as “As-Is” are sold without warranty, express or implied, except where prohibited by law.
Customer acknowledges responsibility for inspection prior to purchase.
9. Limitation of Liability
Dakota Subaru Experts shall not be liable for:
Pre-existing conditions not related to the authorized repair
Indirect, incidental, or consequential damages
Loss of vehicle use
Rental car expenses
Lost wages
Towing costs unless pre-approved in writing
Total liability shall not exceed the amount paid for the specific repair or vehicle purchase in question.
10. Customer Responsibility
Customers are responsible for:
Providing accurate vehicle information
Maintaining proper fluid levels and routine maintenance
Ceasing operation if warning lights or overheating occurs
Reviewing estimates before approval
Continued operation of a vehicle after warning indicators may void warranty coverage.
11. Abandoned Vehicles & Storage
Vehicles not picked up within 7 days after notification of completion may be subject to storage fees.
Unpaid or abandoned vehicles may be processed in accordance with North Dakota abandoned vehicle and mechanic’s lien laws.
12. Communication Consent
By providing contact information, customers consent to communication via phone, SMS, and email regarding services, approvals, and transactions.
Message and data rates may apply.
13. Force Majeure
Dakota Subaru Experts shall not be liable for delays or failure to perform due to circumstances beyond our reasonable control.
14. Governing Law
This Agreement shall be governed by the laws of the State of North Dakota.
